J12/2074/24.05.2016, CUI 36120091, hereinafter referred to as " INFSD SWIMWEAR ".

Please note that we reserve the right to change, modify, add or delete parts of these terms and conditions at any time without notice and, unless otherwise stated, such changes will become effective immediately; as such, please check the contents of these terms and conditions periodically. Your continued use of the Site after changes to this Agreement constitutes your agreement. regarding the changes made.

DISTANCE CONTRACT - any contract concluded between the professional and the consumer within an organized distance sales or service provision system, without the simultaneous physical presence of the professional and the consumer, with the exclusive use of one or more means of distance communication , up to and including the moment when the contract is concluded;
CONTENT – all information on the website that can be visited, viewed or otherwise accessed using an electronic device.
TRANSACTION - collection or reimbursement of an amount resulting from the sale of a product by INFSD SWIMWEAR to the Customer, by using the services of the card processor agreed by INFSD SWIMWEAR , regardless of the method of delivery

Transactions can only take place on the territory of Romania. Deliveries to addresses in other countries are not accepted for Orders placed using the www.infsd.com platform.

Intellectual property right

1.1. The design and way of presentation of the website, as well as its settings, menus, submenus and functionalities are the property of INFSD SWIMWEAR .

1.2. The website, brands, logos, slogans, texts, images, databases, as well as all other materials and elements that are part of the website are the property of INFSD SWIMWEAR or its partners and are subject to an intellectual property right , in accordance with applicable Romanian and international legislation.

1.3. It is forbidden to reproduce, distribute or publish, in any form, the content of the website and the elements presented on this website, by any person, without the prior written consent of INFSD SWIMWEAR .

1.4. Any attempt, of any nature, to modify the images and information on this website, initiated by any person, with the exception of INFSD SWIMWEAR , as well as the creation of links with unfounded messages, which refer to pages on the website, give the right unilaterally and unequivocally to the company INFSD SWIMWEAR or any other legal beneficiary of the above intellectual property rights to use all its prerogatives to address the legally competent courts for the sanctioning of these facts. Nothing contained on this website should be construed as granting a license/right to use any trademark displayed on this website without the written permission of INFSD SWIMWEAR .

1.5. It is prohibited to transmit to this website, or to the e-mail addresses mentioned in its sections, any materials considered illegal, dangerous, defamatory, obscene, pornographic or vulgar, and materials that could be considered to incite acts that violate the law .

Use of the Website

2.1. The website can be accessed for free. INFSD SWIMWEAR does not guarantee that the website will be permanently accessible without interruption. INFSD SWIMWEAR may suspend, withdraw, terminate or modify the website in whole or in part without prior notice.

2.2. INFSD SWIMWEAR will not be held responsible in the situation where the website cannot be accessed, regardless of the reason for the impossibility of access and regardless of the duration of this impossibility.

2.3. The user is responsible for performing all the necessary actions to access the website. Also, the user is responsible for ensuring that all persons who access the website through the internet network made available by it, know and implement these Terms and Conditions of Use, as well as any other applicable conditions.

2.4. Any person who wants details about the services or products presented on the website is asked to contact INFSD SWIMWEAR representatives, to find out both about the availability of the service or product in question, and about the contractual conditions. INFSD SWIMWEAR reserves the right that access to the products and services described in this website may be restricted to certain persons or in certain areas/countries. None of the products or services presented on the website will be provided to a person by INFSD SWIMWEAR , if Romanian legislation prohibits this.

ONLINE SALES POLICY

3.1. Users who have or create an account on the website have the possibility to pay orders through the website. The online store will only honor Orders with a delivery address on the territory of Romania.

3.2. Sharing an account between multiple Users is prohibited. If such actions are discovered, INFSD SWIMWEAR reserves the right to cancel or suspend the Users' access to the website or to suspend/close the account.

3.2.1 For products showing manufacturing damage upon receipt, or if the Customer was delivered a different product than the one ordered, INFSD SWIMWEAR will proceed to replace the product/products, without being able to request the payment of damages, or upon reimbursement of the product value within 14 days of receiving the returned product.

3.22.2. The consumer customer has the right to unilaterally denounce the distance contract , based on the right of withdrawal provided by law, without penalties and without citing a reason, within 14 calendar days from the date of taking possession of the product.

3.3. INFSD SWIMWEAR can publish on the website information about products and/or promotions practiced by it or by third parties with which INFSD SWIMWEAR has concluded partnership contracts, during a certain period and within the limit of available stock.

3.4. The products purchased through the website are intended exclusively for the personal use of the Customer.

3.5. INFSD SWIMWEAR can limit the ability to purchase some products or services available on the website at a given time, to one or more Customers.

3.6. All prices related to the products or services presented on the website are expressed in RON (RON) and include VAT.

3.7. The rates shown on the website crossed by a dash mean the initial price for sale, before the discount.

3.8. Invoicing of purchased products is done exclusively in lei (RON). The accepted payment methods are the following:

- online with bank card,

- with payment order,

- in the reimbursement system.

3.9. In the case of online payments, INFSD SWIMWEAR is not/cannot be held responsible for any additional costs incurred by the Customer, including but not limited to currency conversion fees applied by the card issuing bank, if the issuing currency of it differs from RON. Responsibility for this action rests solely with the Customer.

3.10. In the description of the products and/or services, INFSD SWIMWEAR reserves the right to use other products (for example accessories) that may not be included in the costs of the respective products. The images are displayed as a presentation on the website, and the products actually delivered may differ from the displayed images in any way (color, accessories, appearance, etc.), due to external factors such as the light used.

3.11. INFSD SWIMWEAR reserves the right to change the rates charged for the products available on the website, before placing the Order by the Customer, without prior notification to the Customer.

3.12. The purchase price of the products is the one at the time of placing the Order, within the limit of available stock.

3.13. The purchase price of the promotional products is the one from the moment the Order is placed, within the limits of the available stock and/or the promotional period, if this is defined.

3.14. The purchase price of the products in an issued Order cannot be changed at a time after its issuance except with the agreement of the parties.

3.15. By completing the Order, the Customer agrees that INFSD SWIMWEAR can contact him, for the following purposes/situations, by any means available/agreed by INFSD SWIMWEAR , depending on the purpose/situation:

- Non-acceptance by the issuing bank of the Client's card, of the transaction, in the case of payment by bank card;

- Invalidation of the transaction by the card processor approved by INFSD SWIMWEAR , in case of payment by bank card.

- For the mandatory validation of the availability of the products and the quantities purchased by the Customer within a maximum of 48 hours from placing the Order.

- Validation by the Customer of the value of the Order made, and including, depending on the situation, other value-added services (ie transport, etc.)

- Establishing by mutual agreement the details of product delivery.

3.16. INFSD SWIMWEAR can automatically cancel the Order made by the Customer, without any subsequent obligation of either party to the other or without any party being able to claim damages to the other, in the following cases:

- non-acceptance by the issuing bank of the Client's card, of the transaction, in the case of online payments;

- invalidation of the transaction by the card processor approved by INFSD SWIMWEAR , in the case of online payment;

- the data provided by the Client on the website are incomplete or incorrect;

- the Client's activity on the site can and/or cause damages of any kind on the part of INFSD SWIMWEAR and/or its partners.

3.17. If, when placing the Order, the Customer opted for card payment, after validating the Order, the Customer has the obligation to enter the data necessary to process the payment.

3.18. The steps to complete an Order are:

The customer chooses the products and adds them to the shopping cart;
When the Customer decides to place the Order, select the buy option;
After selecting the payment method, the Client is obliged to enter the requested data, in the case of payment by card, the client will be asked for additional data to process the payment.
The order is being processed and the delivery will be made.

3.18.1. If the customer has chosen the payment method by bank card, and the value of the ordered products has been blocked on his card, he has the right to modify the content of his order, at the moment he is contacted by INFSD SWIMWEAR, within the limit of the blocked value on his card.

3.18.2. If, upon confirming the Order, the Customer finds that certain products Ordered by him are not available, he has the right to cancel the Order, to process the Order without the missing products or to add other products to the Order. If the Customer modifies the initial Order, it is considered a new Order and is subject to the steps provided above.

3.18.3 From the moment the Customer validates the counter value of the Order placed or if INFSD SWIMWEAR informs the Customer about the validated Order, his Order becomes a Distance Contract, according to Emergency Ordinance no. 34/2014 regarding the rights of consumers in contracts concluded with professionals, as well as for the modification and completion of some normative acts.

3.18.4 The Customer can also make Telephone Orders.

3.19. Transport

3.19.1. INFSD SWIMWEAR will include in the package sent to the Customer all the necessary documents to certify the purchase of the products by the Customer.

3.19.2. INFSD SWIMWEAR will facilitate informing the Client about the completion stage of the Order or the contract.

3.19.3 . The customer has at his disposal the following mode of transport: courier (the fees related to this will be communicated to you).

3.19.4 . The delivery fee is at least 25 RON. The delivery cost will be displayed on the checkout page

CAREFUL! Products are delivered to the Customer only to an adult on the basis of an identity document!

3.19.5 . Deliveries will be made only on the territory of Romania, on average within 5 days from the confirmation of the Order, without exceeding the 30-day period. In the event that the product cannot be delivered, INFSD SWIMWEAR undertakes to inform the Customer about this unavailability, and the amounts that he paid as payment will be reimbursed by INFSD SWIMWEAR within a maximum of 30 days.

3.20. Quality and guarantees

3.20.1. Certain products may benefit from a contractual guarantee and this will be mentioned in the product sheet during its exclusive sale on the www.infsd.com website. Clear details related to these guarantees are given by the product sheets and no Customer can request an extended guarantee, more than the one mentioned. This means that the product warranty offered by INFSD SWIMWEAR is the one offered by INFSD SWIMWEAR suppliers.

3.20.1. INFSD SWIMWEAR does not guarantee the stock availability of any product available for purchase on the website.

3.21. Return of products and withdrawal from the contract

3.21.1. Any INFSD SWIMWEAR Customer can return the products purchased through the website, in the following situations:

- The parcels/products show severe damage,

- The products were delivered incorrectly,

- The products have wrongly ordered sizes (thicknesses).

In order to make a complaint/notification regarding the delivered products, the Customer must contact INFSD SWIMWEAR in writing, at the email address hello@infsd.com or by another means that ensures confirmation of receipt, within 3 days of receipt the products.

INFSD SWIMWEAR will proceed to analyze the complaint and, if it is justified, to remedy the situation, in the shortest possible time.

For products showing manufacturing damage upon receipt, or if the Customer was delivered a different product than the one ordered, INFSD SWIMWEAR will proceed to replace the product/products, without the possibility of requesting the payment of damages or the reimbursement of the consideration of the product within 30 days of receiving the returned product.

If the products have the wrong sizes/thickness ordered, INFSD SWIMWEAR will proceed to replace the product. If the Customer has returned a product, and INFSD SWIMWEAR does not have an identical product for replacement, it will offer the Customer the counter value of the product within 30 days of receiving the returned product.

The replacement will be made under the conditions and limits of a standard order.

The value of the additional services, including but not limited to the transport of the products, paid by the Customer, is not reimbursed. In all cases, the costs of return/re-shipment will be borne by the Customer.

3.22.2. The consumer customer has the right to unilaterally terminate the distance contract , based on the right of withdrawal provided by law, without penalties and without citing a reason, within 30 calendar days from the date of taking possession of the product. The only costs that can be borne by the consumer are the direct costs of returning the products according to Emergency Ordinance no. 34/2014 regarding the rights of consumers in contracts concluded with professionals, as well as for the modification and completion of some normative acts , for natural persons who purchase products from websites, using remote communication techniques, applying the definitions contained in Emergency Ordinance no. 34/2014.

According to the legislation in force, a consumer is considered any natural person or group of natural persons constituted in associations, as defined in art. 2 points 2 of Government Ordinance no. 21/1992 on consumer protection, republished, with subsequent amendments and additions.

3.22.3. In order to exercise the right of withdrawal, it is sufficient for the Customer's declaration of exercising this right sent to our company in any way, followed by our company's immediate response confirming the receipt of the withdrawal request by e-mail to the address indicated by the Customer.

3.22.4 The customer will notify INFSD SWIMWEAR of his intention to return the purchased products, by any means of written communication (e-mail, etc.) within a maximum of 30 working days from the receipt of the products, in the case of art. 7.9.1.4.

3.22.5 The customer who notified INFSD SWIMWEAR according to art 3.22.3, 3.22.4, has the responsibility to ensure that the products referred to will be returned to INFSD SWIMWEAR within a maximum of 30 calendar days from the date of sending the notification, otherwise, the right of withdrawal no longer operates, considering the request invalid.

3.22.6. The INFSD SWIMWEAR customer cannot return the products purchased through a Contract, and/or cannot claim any other damages/compensations, if the returned product is not in the same condition in which it was delivered (in the original packaging with all the labels intact, the seal intact and the documents that accompanied it, without traces that may indicate that the product has been worn).

3.22.7 Conformable Emergency Ordinance no. 34/2014 regarding the rights of consumers in the framework of contracts concluded with professionals, as well as for the modification and Completion of some normative acts INFSD SWIMWEAR reserves the right not to accept returns for products which, by their nature, cannot be returned or which can degrade or deteriorate quickly.

3.22.8 In the case of reimbursement of the product value, this will be done within 14 days from the date on which the consumer is informed of the decision to withdraw from the contract. For orders paid by card, the amount will be returned to the same bank account used for the transaction.

3.22.9 INFSD SWIMWEAR is not obliged to reimburse additional costs if the Consumer has explicitly chosen a type of delivery other than the standard delivery offered by the Seller. INFSD SWIMWEAR may postpone the reimbursement until the date of receipt of the products that were the subject of the sale.

3.22.10 The consumer is informed of the fact that, if the products returned show signs of wear, scratches, bumps, mechanical or, as the case may be, electrical shocks, missing accessories, missing warranty certificates, INFSD SWIMWEAR reserves the right to to decide to accept the return or to withhold an amount from the value of the product. If the returned product is damaged or the packaging is opened, INFSD SWIMWEAR reserves the right to charge an additional fee of 0-50% of the value of the products, a fee to cover the costs of returning the products to their original condition. This amount will be deducted from the initial payment for the products.

Warranties and Responsibilities

4.1. The use of the website is solely at the User's risk.

4.2. Likewise, INFSD SWIMWEAR will not be liable for any damage caused by a virus, denial-of-services or distributed denial-of-services attack, as well as by any other type of technological material that would infect the computer, the system IT and/or User data as a result of accessing the website or other websites to which there are links in this website. Any links to other websites are provided only for the purpose of increased accessibility of information, INFSD SWIMWEAR does not assume any responsibility or liability for the content of these websites, for the products or services promoted or sold through these websites. 4.3. INFSD SWIMWEAR reserves the right to, at any time, temporarily or permanently delete the Content or parts thereof, the User thus acknowledging that INFSD SWIMWEAR cannot be in any way liable to users or to third parties for such suspensions or interruptions.

4.4. INFSD SWIMWEAR assumes no responsibility for any interruption or omission of internet/network/hosting services.

5.1. The Website may contain links of the "LINK" type to other Internet resources/pages, the User thus acknowledging the fact that the INFSD SWIMWEAR company cannot in any case be considered responsible for the proper functioning of these external resources.

5.2. INFSD SWIMWEAR has no obligation to verify the information and content contained in said external resources.

Modifying the content of the Website

6.1. INFSD SWIMWEAR reserves the right to modify the structure and/or content of the website, at any time and without any prior notice.

6.2. INFSD SWIMWEAR makes every effort to provide Users with updated and accurate information and to present, as clearly and concisely as possible, all the information on this website. 8.2. Disputes resulting from the interpretation or execution of these terms and conditions will be resolved by the competent courts in the Mun. Cluj-Napoca.

8.3. If any provision of this document is considered invalid by the competent legal authorities, the invalidity of such provision will not affect the validity of the other provisions of the terms and conditions of use, they will remain in force.

8.4. This document constitutes in its entirety an agreement concluded between the User and INFSD SWIMWEAR SRL regarding the use of the website www.infsd.com
